For a party that spends so much energy claiming to be the Defenders of Democracy™ they sure do have a lot of policy that violates laws or destroys a citizen’s rights.
It’s almost as if they call MAGA the ‘extremists’ so that nobody will notice the real extremists are the guys currently running the government.
Here’s another example.
Just yesterday, a judge in California — CALIFORNIA! — ruled that laws requiring background checks for the purchase of ammunition was a violation of the Second Amendment.
California cannot enforce a law requiring people to undergo background checks to buy ammunition, because it violates the constitutional right to bear arms, a federal judge has ruled.
In a decision made public on Wednesday, U.S. District Judge Roger Benitez in San Diego said the background checks have “no historical pedigree,” and violate the Second Amendment by treating all citizens as having no right to buy ammunition.
“A sweeping background check requirement imposed every time a citizen needs to buy ammunition is an outlier that our ancestors would have never accepted for a citizen,” wrote Benitez, an appointee of Republican President George W. Bush. — Reuters
That should serve as a reminder that what Biden’s ATF is proposing will probably face the same problem.
But that hasn’t stopped pencil-pushing bureaucrats from playing petty potentate by writing regulations with the defacto force of law, to hell with what Congress has to say about the matter. So much for ‘shall not be infringed’.
(That is precisely why the Chevron case before SCOTUS is such a big damned deal, by the way. Depending on the ruling, it could put an end to that precedent and strip these clowns of the power they keep collecting for themselves to rule over ordinary Americans.)
Like all the other woke subversives in this administration, leadership of the ATF has been populated by Biden appointees who think it was a mistake to include the Second Amendment in the Bill of Rights. As you would expect of such activists, they are creating shadow legislation that reflects those views.
But it was done at the direction of Biden’s White House. Meaning the subversion of the Bill of Rights is coming from the White House itself… meaning Joe Biden is directly responsible.
(House Oversight might want to consider adding that to the growing list of reasons to impeach him.)
President Joe Biden’s administration has drafted a document that would effectively ban private gun sales by requiring background checks for all transactions, even those made between private citizens, according to a whistleblower group.
The U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) drafted the 1,300-page document, which provides legal justification for a proposed rule that would require background checks for all gun sales, Empower Oversight Whistleblowers & Research said in a letter on Jan. 31.
The document was drafted at the direction of the White House, according to two whistleblowers who communicated with the organization.

“This ATF rule is nothing more than a complete and utter overreach by non-elected bureaucrats who appear to not want the citizens of the U.S. to continue a tradition of privately buying and selling firearms that has been in existence since before the founding of this country,” one wrote.
Empower Oversight says that the whistleblowers identified Eric Epstein, an ATF lawyer, as overseeing the drafting of the finalized rule.
Empower Oversight is asking the DOJ, under the Freedom of Information Act, for all emails to and from Mr. Epstein discussing the rule; communications between the DOJ and ATF on implementing President Biden’s executive order; communications between the DOJ or ATF and the White House on the implementation; and DOJ and ATF records that contain remarks relating to regulating or banning firearm sales between private individuals. — EpochTimes
