This story is a little like the weather in some places: if you don’t like a ruling on the SB4 issue — just wait a minute and it will change.
And this time it really was almost that fast.
The law passed in Texas — known as SB4 — allowing law enforcement to enforce the border when Mayorkas refuses to is being batted around like a tetherball. Is it in force or not?
Well, it was — and now it’s not.
SB4 is the legislation that empowers Texan law enforcement to lay criminal trespass charges on anyone crossing the border illegally — it also allows for incarceration or sending them back to Mexico.
Remember all that chest thumping by Democrats about how they REALLY wanted to secure the border, but the mean old GOP just kept standing in their way? That was a lie. The fact that Biden’s DOJ is fighting the implementation of this law tooth-and-nail is proof.
Yesterday there wasn’t just one, but two rulings concerning the border. In the first one, SCOTUS lifted the lower court injunction which placed a hold on enforcement of the legislation.
The Biden administration was pissed, as you can tell by their denunciation of the ruling.

Biden’s people and Mexico both hated it. Which really tells you something about how effective this legislation could be at slowing traffic across the border, at lest in Texas.
His DOJ has been pressing the issue — just like he has been bringing suit against any other policy or physical barrier raised to block the border — and we saw a ruling from a 3-judge panel in the 5th Circuit later that day.
But by a 2-1 order, a panel of the appeals court lifted that pause ahead of arguments before the court on Wednesday.
Texas authorities had not announced any arrests made under the law.
Earlier Tuesday a divided Supreme Court had allowed Texas to begin enforcing a law that gives police broad powers to arrest migrants suspected of crossing the border illegally as the legal battle over the measure played out. — NYPost
They want the border open, and they aren’t happy about Texas figuring out a way to block them.
